Terms of service

These terms govern your use of Divide — the web application at this site and the bespoke trip planning service (together, the "Service"), operated by Malcolm McSwain ("Divide", "we"). By creating an account or purchasing a planning package, you agree to them.
1. The service
Divide provides trip-planning software (itineraries, permit checklists, weather summaries, share links) and, separately, flat-fee custom planning delivered by a person. Weather and permit information comes from third-party sources and may be incomplete or out of date. The Service is planning assistance only — see the Safety disclaimer, which is part of these terms.
2. Accounts
You're responsible for your account credentials and for what happens under your account. You must be at least 18 to purchase. Keep your email current — it's how we reach you about trips and billing.
3. Subscriptions and billing
The free plan includes one active trip. Pro is billed monthly or annually through Stripe and renews automatically until canceled. You can cancel any time; access continues through the paid period. Prices may change with notice ahead of your next renewal.
4. Bespoke planning packages
Packages are flat-fee, paid up front. If we can't take your trip on, you get a full refund. Once planning has started, refunds are pro-rated at our reasonable discretion. Deliverables are for your party's personal use. We plan; you decide. We do not book permits or reservations on your behalf unless explicitly agreed in writing — the checklist tells you what to book and when.
5. Your content
Trips you create are yours. You grant us the license needed to store, display, and share them as you direct (for example, via a share link you enable). Share links are public to anyone with the URL until you turn them off.
6. Acceptable use
No scraping, reselling, or abusing the Service; no uploading unlawful content; no attempting to access other users' data.
7. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, or for injury, death, loss, or damage arising from outdoor activities — see the Safety disclaimer.
8. Termination
You can delete your account at any time. We may suspend or terminate accounts that violate these terms. Sections 5–9 survive termination.
9. Changes and contact
We may update these terms; material changes will be announced by email or in-app. Questions: the email on your receipt reaches a human — Malcolm.
